Parties. This agreement is between 210 Equipment Rental LLC ("we") and the person booking ("you"). By typing your name you agree to these terms for the equipment and dates in your booking.
Eligibility. You are at least 21, have a valid driver's license, and are the person who will pick up or receive the equipment. For trailers you have current auto liability insurance on the towing vehicle.
Towing (trailers). Your truck is rated to tow at least 14,000 lb and has a 2 5/16 in ball, a working 7-pin plug and an electric brake controller. You will cross the safety chains, test the lights and brakes, tarp every load, and keep the trailer in Texas.
Loads. You will not exceed about 9,800 lb of cargo or haul hazardous waste, chemicals, paint, tires, batteries, asbestos or liquids. Overloading or prohibited material is your responsibility, including disposal costs and damage.
Skid steer. We deliver and pick up the skid steer. You will operate it only on the delivery site, keep bystanders clear, call 811 before digging, and not exceed 10 hours of run time per rental day. Only you or people you supervise and authorize may operate it.
Condition and photos. You will inspect the equipment and take photos before use. Report any damage right away. You return it in the same condition, swept out, with the bed lowered, and with the skid steer refueled.
Deposit and charges. We hold a refundable security deposit on your card. We may apply it to cleaning, fuel, late returns, lost items or damage beyond normal wear, and charge the card on file for amounts above the deposit. Late returns are charged by the hour and then by the day.
Responsibility. From pickup or delivery until we have the equipment back, you are responsible for it, for loss or theft, and for damage to it or caused by it, including traffic tickets and tolls. You agree to indemnify us against claims arising from your use, except those caused by our gross negligence.
Breakdowns. If the equipment fails through normal use, stop using it and contact us. Our liability is limited to repairing or replacing the equipment or refunding the rental for the time it was down.
Cancellation. Cancel at least 24 hours before your start time for a full refund. Later cancellations may be charged one day of rent.
Taxes. Texas motor vehicle rental tax applies to trailer rentals and Texas sales tax applies to skid steer rentals and delivery.
Governing law. Texas law governs this agreement. Disputes will be handled in Bexar County, Texas.
